Terms & Conditions

The Legal Notice published on this website identifies the owner as established in Article
10 of the Spanish Law on Information Society Services and Electronic Commerce, and
contains information regarding the personal data protection policy.
 
The products offered on this website are intended for consumer use; therefore, the
purchase agreement is deemed executed at the moment the customer expressly confirms
the order. For this reason, THE VELIO BRAND recommends reading the entire legal
notice and these general terms and conditions before accepting the order.
 
This contract is executed within the legal framework established for Electronic
Commerce by Law 34/2002 on Information Society Services and Electronic Commerce,
taking into account Law 7/1996 of 15 January on Retail Commerce Regulation, Law
7/1998 of 13 April on General Contracting Conditions, Royal Legislative Decree 1/2007
of 16 November approving the consolidated text of the General Law for the Defense of
Consumers and Users, and Law 3/2014 of 27 March.

The contracting conditions are as follows:

PRODUCT CHARACTERISTICS

The characteristics of the products offered on this website appear on screen alongside
their visual identification. 

INFORMATION AND PRICES

Please read the product descriptions carefully before purchasing. The images displayed
may differ slightly from the final product, including color tone and fabric texture. If you
have any doubts, please contact us before making your purchase.
 
The characteristics and prices of the products displayed on screen shall be those
corresponding to the products, except in cases of error or omission. Items will remain
available for sale while stocks last. The prices shown on screen are expressed in euros,
do not include VAT, are current, and are valid at the time the order is accepted by us,
except in the case of graphical error or omission.
 
Offers are properly marked and identified. Their validity is effective for as long as they
appear on the website.
 
The sale prices indicated in our Online Store are displayed with Spanish VAT included.
 
Shipping service charges are not included in the product prices. Shipping charges are
borne by the Customer and will be added to the total amount of the selected products.
You will be informed of these charges before confirming the order and completing the
contracting process.
 
Customs duties and tariff charges are not included in the product price. Therefore, if the
order passes through customs, additional costs may arise, which shall be borne by the
purchaser.
 
We reserve the unilateral right to modify our prices at any time. However, we undertake
to apply the rates in force as indicated on the website at the time the Customer places the
order.

LANGUAGES IN WHICH THE ORDER MAY BE PLACED

Spanish, English, German.

STEPS TO PLACE AN ORDER

You must select the items you wish to purchase, indicating the number of units and
clicking the "add to cart" button to include them in the shopping basket. At any time you
may view the contents of the basket, including selected items, their price, and applicable
taxes. Shipping costs will be communicated at the end of the purchase process. From this
same window, before sending the order, you may correct, modify, or cancel the selected
products.
 
You must then accept the Terms and Conditions of Purchase by ticking the acceptance
box. When you have finished selecting products, click "cart" and then "next." You must
provide your email address and personal information. You must also confirm the delivery
address and shipping method.
 
Finally, you must choose the payment method and will be redirected to the payment
gateway. Once the process is completed, you will receive confirmation of the purchase
made.

ORDER RECEIPT CONFIRMATION

Once payment has been made, THE VELIO BRAND will send a confirmation email
acknowledging receipt of the order within 24 hours of receipt, except when the order is
placed on weekends or holidays, in which case the confirmation may be delayed until the
next business day.

PAYMENT METHODS

THE VELIO BRAND offers several payment options.
 
Payment for products shall be made using one of the following methods:
 
Credit or debit card: The customer may choose to pay by credit card, and the transaction
will be confirmed at the moment the order is placed.
Apple Pay: The user acknowledges that payment through this method implies acceptance
of Apple Pay's privacy conditions, which are independent from those of this website.
Google Pay: The user acknowledges that payment through this method implies
acceptance of Google Pay's privacy conditions, which are independent from those of this
website.

RIGHT OF WITHDRAWAL

In accordance with the General Law for the Defense of Consumers and Users, the
customer shall have the right to return all or part of the order within 14 calendar days
without providing any justification, except in cases of legal exception.
 
The withdrawal period will expire 14 calendar days from the date of receipt of the order
by the customer. To exercise the right of withdrawal, the customer must notify their
decision to withdraw from the contract through an unequivocal statement sent by email
to: theveliobrand@gmail.com. The email must include the following information: an
unequivocal statement of withdrawal, order reference or number, products to be returned,
name, address, and payment method. No return will be considered valid if it is not
requested in the manner indicated and through this email address.

THE VELIO BRAND will acknowledge receipt of the request and provide instructions
to proceed with the partial or total return of the order.

THE VELIO BRAND will refund all payments received from the customer, excluding
delivery costs where applicable, without undue delay and in any case no later than 14
calendar days from the date the returned order is received at the address provided to the
customer in the return instructions. The refund will be made using the same payment
method used by the customer for the initial transaction.

For the return to be valid and for the refund to be issued, the product must meet the
following conditions:

Be in perfect condition, unused, and in its original packaging, inside a protective bag or
box, with no signs of use, odors, or washing.

Include labels, accessories, and any other elements originally sent.

No return will be accepted if the item has been used beyond simple unpacking, has
suffered damage, or has any odor (including perfume or detergents). Items must be
returned in the same condition in which they were sent: unused, unwashed, and with all
labels. If the product is not returned in perfect condition, the customer will bear the
shipping costs to retrieve it.

The withdrawal period shall be deemed met if the customer returns the goods before the
14-day period expires. The customer shall bear the direct costs of returning the order, and
may send the item by post or any carrier of their choice, with postage prepaid, to the
address provided by email once the required information has been received. Until the
return shipment is received by THE VELIO BRAND, the customer is responsible for the
goods and their condition.

The customer shall be liable for any diminished value of the goods resulting from
handling other than what is necessary to establish their nature, characteristics, or
functioning.

THE VELIO BRAND carefully inspects all items before dispatch. In the event of a
DEFECT or FAULT, it must be reported to theveliobrand@gmail.com within a maximum of 24 hours from receipt. Such claims will only be accepted if the product retains its labels and has no odors of any kind (perfume, detergent, etc.). Otherwise, it shall be understood that the item has been used and the defect caused by improper use.
 
If your order benefited from a free-shipping promotion due to reaching the required
minimum amount, and you make a return or any item is cancelled due to lack of stock or
for any other reason that affects the total amount ( and the minimum is no longer met), the
customer must pay the applicable shipping costs, as the order no longer qualifies for the
free-shipping promotion.

SHIPPING METHODS, DELIVERY TIME, TRANSPORT, AND SHIPPING COSTS

Shipping costs are not included in the product prices. Shipping costs will appear for the
user's express acceptance before finalizing the purchase and once the delivery address is
provided. Shipping costs will appear on the invoice. In case of return, shipping costs are
borne by the customer.
 
THE VELIO BRAND will charge shipping costs for each delivery.
 
The order will not be shipped until all products are available. If the customer wishes to
receive partial shipments, they must contact THE VELIO BRAND for instructions. To
avoid delays in the delivery of available products, THE VELIO BRAND recommends
placing separate orders for pre-order items and items currently in stock.
 
DELIVERY TIME AND TRANSPORT
 
The average delivery time for shipments within mainland Spain is between 2 and 5
business days, depending on the delivery address, for products in stock. For other
products, the approximate delivery date will be notified after the order is placed, provided
the order is placed Monday to Friday before 14:00. Orders placed on Saturdays or
Sundays will be processed starting Monday or the next business day.
Shipments are made to mainland Spain and to other European Union countries.

PRICING POLICY

THE VELIO BRAND unilaterally reserves the right to modify the price of products
offered through this website. The prices in force at the time the order is placed will be
applied, ensuring that the customer receives the correct and current price.

ONLINE DISPUTE RESOLUTION

Pursuant to Article 14.1 of Regulation (EU) 524/2013, the European Commission
provides a free-access platform for the online resolution of disputes between consumers
and THE VELIO BRAND, without the need to resort to courts, through the intervention
of a third party known as a dispute resolution body, which acts as an intermediary between
both parties. This body is neutral and will attempt to reach an agreement and may
ultimately suggest or impose a solution on the conflict.

APPLICABLE LAW AND JURISDICTION

These conditions shall be governed by and interpreted in accordance with Spanish law in
all matters not expressly provided herein. The parties agree to submit any dispute that
may arise regarding the provision of the products or services covered by these Conditions to the courts corresponding to the consumer's domicile. If the consumer resides outside
Spain, the parties expressly waive any other jurisdiction and submit to the Courts and
Tribunals of Madrid (Spain).
